Did you know Kim Kardashian did a commercial for Old Navy? Oh, my mistake, it’s her look-alike according to Kardashian herself. According to “Kim Kardashian sues Gap over look-alike model” by Steve Hargreaves from CNNmoney.com, she sued Gap Inc yesterday claiming the model is purposefully a Kim Kardashian look-alike. The statements quoted in the article from her lawyer and her:
“Old Navy used Kardashian’s likeness in the form of a celebrity look-alike, and styled the infringing ads to evoke Kardashian’s identity and persona”
“Kim Kardashian is immediately recognizable, and is known for her look and style, her identity and persona are valuable. When her intellectual property rights are violated, she intends to enforce them”
“I’ve worked hard to support the products I’m involved in and personally believe in”
I have seen the commercial (and re-watched it) with this so-called “Kim Kardashian look-alike”. When I first saw it, I thought nothing of Kim Kardashian but, more so, of the many young women who fashion themselves after the look presented in the commercial. If you take a good look, the model could be Kim Kardashian or the multitudes of teen girls who wander the mall. Kim Kardashian owns her likeness but not her styled look; it’s as if she is saying, “I’m suing because I would dress that way and no one else could have the same fashion style”. In her defense, if Gap Inc. did not intend to copy Kardashian, the company would have simply stated so. I find it weird that Gap, Inc. had no statement to give; they claim they can’t give a statement without having yet to see the lawsuit. The lack of statement could imply that their marketing department did intend to use a Kim Kardashian look-alike.
